  Slip and Fall on Snow or Ice - Who is Liable?

At Cellino & Barnes, we see many slip and fall accidents occur as a result of the negligence of property owners who fail to remove snow and ice.

Who is Liable?  In many jurisdictions, property owners are required to keep up with the snow and ice removal on their property, which may include parking lots and sidewalks.

Property owners are often allowed a "reasonable" amount of time to remove the snow and ice. For example, if you fall on a snowy sidewalk in the middle of a snowstorm, the property owner may often not be held liable since the storm was in progress.

If, however, you have suffered an injury and had previously complained about the hazardous condition to your landlord or property owner, and they did failed to correct the problem, you may have a claim for personal injury.
