How Do I know if I have a Claim?
There are three factors that generally must be proven in order to make a claim in a food poisoning case.
- There should be evidence to show that the food was contaminated with foodborne bacteria. (This can be shown by either scientific confirmation, or sometimes if a group of people became ill around the same time at a particular restaurant.)
- Proof is needed to show that the contaminated food actually caused the illness.
- As a result of the food poisoning, the person should be able to show he or she was harmed physically, mentally or financially.
