Wall Collapses On N.J. Worker

/ Construction Accidents, News /

LOWER ALLOWAYS CREEK TWP., N.J. – Another New Jersey construction accident killed a worker this week after a wall collapsed on Nauro Ramos-Ramirez in Lower Alloways Creek Township.

Police said Nauro Ramos-Ramirez, 22, of Bridgeton was working on a house remodel in Salem County when a foundation wall collapsed, trapping Ramos-Ramirez under the debris of the home on Maskells Mill Road.

Nauro Ramos-Ramirez was working for DeWitt Concrete and Masonry Inc. of Bridgeton, according to police. Although no charges were filed, police said the U.S. Occupational Safety and Health Administration (OSHA) will conduct a full investigation of the incident.

New Jersey construction accident lawyers said OSHA requires employers to provide workers with a safe working environment. This includes providing workers with the proper safety equipment and training before putting them in potentially dangerous situations.

According to OSHA, falling materials and building collapses are responsible for nearly 200 deaths every year in America. Safety experts say all of these accidents are preventable with the proper equipment and safeguards in place. New Jersey Tractor Trailer Crash Sends Three To Hospitals

/ News, Truck Accident /

CLIFTON, N.J. – A tractor-trailer driver won’t face any charges after a serious crash sent three people to New Jersey hospitals, officials said. According to authorities in Clifton, William Libby, 46, of Pennsylvania, Irving Vasquez Velez, 32, of Paterson, and Fabian Macedonio, 36, of Clifton were all injured in the crash.

Police said the truck driver lost control of his tractor-trailer after a swerving car cut him off, forcing the truck to cross a concrete barrier into oncoming traffic. Irving Vasquez Velez and Fabian Macedonio were both heading westbound when the truck crossed the barrier into their lanes. Clifton firefighters said Irving Vasquez Velez was trapped in his car after the crash, forcing firefighters to cut the vehicle open to free him.

Police said the accident shut down all three lanes of the highway between Main Avenue and Route 21 in Passaic County.

Several other drivers stopped and jumped into action to help Irving Vasquez Velez, Fabian Macedonio and William Libby after the crash, according to NorthJersey.com. Witnesses told reporters they carried one of the drivers away from the wreckage while they waited for help to arrive.

Over the last few years, serious truck crashes like this have spiked according to the Insurance Institute for Highway Safety. Last year alone, there were nearly 3,000 deadly truck crashes on US roadways, and thousands of others that resulted in serious injuries.

According to New Jersey truck accident lawyers, many truck crashes can be blamed on the inattentiveness of other drivers. However, a complete investigation can help victims of truck accidents get compensation for their injuries.

An experienced New Jersey truck accident attorney will look at many potential factors, including:

  • Surveillance video
  • Traffic signals
  • Dashcam video from the truck itself or other drivers in the area
  • Road striping
  • Truck maintenance records
  • How long the driver was on the road
  • Overall road safety
  • Truck driver safety records
  • And More

In most situations, truck accident victims and their families will need to file personal injury claims to get fair compensation for their injuries. A settlement or court verdict may determine that victims be compensated for their injuries and distress, including:

  • Expenses from hospitalization
  • Medical treatments
  • Loss of financial support from the victim
  • Pain and suffering
  • And More…

Oftentimes, a successful truck accident claim will also help create changes in our communities that aim to improve roadway and traffic safety for those who share the road in Clifton, Passaic County, New Jersey, and on highways across the country.

If you or a family member has been injured in any type of truck accident, you may want to contact an experienced New Jersey truck accident lawyer to help you get the best result possible.

If you decide to contact Cellino & Barnes, we’ll put our best New Jersey truck accident lawyers on your case. For a free consultation, call us at (800) 888-8888.

OSHA Investigates Passaic County Fall | New Jersey Construction Accident Lawyers

/ Construction Accidents, News, Uncategorized /

PASSAIC COUNTY, N.J. – A Woodland Park construction worker died Tuesday morning after falling off a roof at a work site in Paterson, New Jersey. Authorities said Joseph Perillo, 56, of Woodland Park was working on the roof at 138 Michigan Avenue when he fell off the building.

Joseph Perillo was taken to St. Joseph’s University Medical Center where he was pronounced dead, first responders said. According to the U.S. Occupational Safety and Health Administration (OSHA), investigators were called to the Passaic County accident scene to determine what happened, and if there were any workplace violations.

According to New Jersey construction accident lawyers, OSHA requires employers to provide workers with fall protection systems, such as guardrails and safety nets, when working on a surface above 6-feet. Authorities said there’s no evidence of foul play, and it is unclear if any fall protection systems were in place at time of Joseph Perillo’s accident.

In general, falls are the top cause of construction accidents. Safety experts say they’re almost always preventable with the proper equipment and safeguards in place. That’s why it’s important to conduct a complete legal investigation of an accident; it can help workers and their families find out what went wrong, and why.

Remember, it’s the employer’s responsibility to provide workers with enough training and the right safety equipment before placing them at a dangerous construction site. Unfortunately, not all employers follow these mandates.

In many cases, families have called on a New Jersey construction accident lawyer to investigate an accident, and help get them compensation for any of the following:

  • Medical bills
  • Lost wages
  • Physical assistance
  • Future treatments
  • Wrongful death
  • Pain & Suffering
  • And More

If you or a family member has recently been injured on a construction site, you can count on Cellino & Barnes to be on your side. What Caused A Deadly Upstate New York Limousine Accident?

/ News, Uncategorized /

SCHOHARIE, N.Y. – Investigators are calling it the nation’s deadliest accident in nearly a decade. The National Transportation Safety Board (NTSB) said a limousine carrying 18 people to an Upstate New York birthday party blew past a stop sign, crashing into a parked car and two pedestrians near Albany on Saturday.

In total, 20 people were killed, including:

  • Erin Vertucci McGowan
  • Shane McGowan
  • Amanda Halse
  • Patrick Cushing
  • Mary Dyson
  • Rob Dyson
  • Allison King
  • Abigail Jackson
  • Adam Jackson
  • Amy Steenburg
  • Axel Steenburg
  • Rich Steenburg
  • Matthew Coons
  • Savannah Bursese
  • Amanda Rivenburg

At the time this article was published, the NTSB had not released an official list of victims, but family members have confirmed that Erin McGowan, Shane McGowan, Amanda Halse, Patrick Cushing, Mary Dyson, Rob Dyson, Allison King, Abby Jackson, Adam Jackson, Amy Steenburg, Axel Steenburg, Rich Steenburg, Matthew Coons, Savannah Bursese, and Amanda Rivenburg were all friends or family members.

The group, including two newlyweds (Erin and Shane McGowan) had rented the limousine to celebrate Amy Steenburg’s 30th birthday. According to several media reports, the party of 17 were taking the 2001 Ford Excursion limousine to an upstate New York brewery in Cooperstown. Officials said the trip was tragically cut short when the limo missed a stop sign at a dangerous intersection in Schoharie, New York, about 40 miles west of Albany.

Robert Sumwalt, chairman of the National Transportation Safety Board, said investigators with the federal agency are working to determine what caused the crash, the worst in the U.S. since 2009.

“It’s important to figure out what happened and why it happened to prevent things like this from happening in the future,” Sumwalt said during a news conference Sunday.

Limousine Safety Called Into Question

The crash may be the deadliest accident in the U.S. this decade, but there has been a deadly limo accident every year since at least 2000. Those crashes are blamed for 68 deaths.

“This does need to be a wake-up call,” Sumwalt told CNN over the weekend. “Here we have 20 lives that have been lost tragically. We do need to learn from this.”

Stretch limos, which are chopped up vehicles then extended in length, are not subject to any regulatory agency. As a result, experts say safety is often overlooked.

Most states do not require seat belts to be worn in limousines, and many limos don’t even feature seat belts.

Sumwalt told reporters that none of the passengers in the limo were wearing seat belts, and it’s unclear at this point whether seat belts would’ve made a difference in this crash However, it is a factor investigators are looking at.

Investigating A New York Limo Accident

An extensive investigation should be able to determine what exactly caused this heartbreaking limo crash in Schoharie, New York. Investigators have already released some of the facts, but families still have many unanswered questions:

  • Was the driver paying attention?
  • How many hours did the driver work?
  • Was the vehicle safe to drive?
  • Was the stop sign clearly visible?
  • Was the limo traveling too fast for road conditions?
  • Was the driver well-trained?
  • Could there have been a malfunction?

These are just some of the questions a full investigation should be able to answer.

Prestige Limousine, the company which owned and operated the limo, had its fleet of vehicles inspected five times in the past five years. Over that time, four vehicles were removed from service, public records show.

It is not yet clear whether the 2001 Ford Excursion limousine had any mechanical issues that could’ve contributed to the limo accident in Schoharie. However, New York limousine accident lawyers say it’s important to gather all the facts, and as much evidence as possible.

The evidence gathered by federal investigators, local police departments and private investigations will be very important for the families of the victims when choosing to file any wrongful death claim. In many cases, limo accident victims and their families choose to file wrongful death claims to hold those responsible for the accident accountable, and get compensation for their injury or loss of a loved one. An experienced NY limo accident lawyer understands how to help the families answer their questions and recover compensation for the loss of financial support from a victim of a tragic limo accident.

A successful limo accident claim can also help make meaningful changes in our communities that can improve limousine safety in New York, and across the nation. Whether it’s adding seat belts, mandating their use, or improved training of limousine drivers, a claim can make a difference.

The goal is to make sure that accidents like the one that killed Erin McGowan, Shane McGowan, Amanda Halse, Patrick Cushing, Mary Dyson, Rob Dyson, Allison King, Abby Jackson, Adam Jackson, Amy Steenburg, Axel Steenburg, Rich Steenburg, Matthew Coons, Savannah Bursese, Amanda Rivenburg and several others can be avoided in the future.

I-84 Tractor-Trailer Crash Claims A Life In Kent, New York

/ News /

KENT, N.Y. – An early morning crash on Interstate 84 killed one driver, and kept the busy eastbound lanes closed for nearly 12-hours. New York State Police said Thomas Cipolla, 52, of Beacon was killed in a crash with a tractor-trailer.

According to State Police, Thomas Cipolla was heading eastbound on I-84 behind a tractor-trailer hauling watermelons. For unknown reasons, the truck struck a guardrail and overturned on the highway. Police said Thomas Cipolla hit the underside of the tractor-trailer, causing both vehicles to catch fire.

The truck driver, identified as Sergio Khundiashvili, 36, of Brooklyn, teamed-up with a passerby and attempted to rescue Thomas Cipolla from his car. However, Mr. Cipolla was pronounced dead at Putnam Hospital Center in Carmel.

Since 2011, fatal truck crashes have spiked 16-percent, according to the Insurance Institute for Highway Safety. In 2016, there were over 2,600 deadly truck crashes.

New York truck accident lawyers say many truck crashes can be blamed on inattentiveness. Particularly in the early morning hours, drowsy driving is a serious problem on America’s highways. According to AAA, drowsy driving is a factor in over 300,000 crashes each year. However, there are many other factors that need to be investigated when a collision involves a large truck.

A thorough legal investigation will look at many of these potential factors, including:

  • Truck maintenance records
  • Truck driver safety records
  • How long the driver was on the road
  • Overall road safety
  • Surveillance video
  • Traffic signals
  • Dashcam video from the truck itself or other drivers in the area
  • Road striping
  • And More

In many cases, truck accident victims and their families choose to file personal injury claims to get compensation for their injury or loss of a loved one. When an experienced NY truck accident lawyer gets involved, families have a higher chance of recovering compensation that can help pay for:

  • Expenses from hospitalization
  • Medical treatments
  • Loss of financial support from the victim
  • Pain and suffering
  • And More…

A successful truck accident claim can also help make meaningful changes in our communities that can improve the safety for others sharing the roadways with big trucks in Kent, Beacon, and on interstate highways across the nation. The goal is to make sure that accidents like the one that killed Thomas Cipolla can be avoided in the future.

Tragic North Bergen Truck Accident Claims Passenger’s Life

/ News, Truck Accident /

NORTH BERGEN, N.J. – A passenger of a car that collided with a tractor-trailer last week has died from his injuries, the Hudson County Prosecutor’s Office said in a news release this week. The driver of the car remains in critical condition at Hackensack University Medical Center.

William David, 36, of North Bergen passed away Sunday morning. The 15th traffic fatality in Hudson County this year, William David was a passenger in a 2013 Infiniti G37 when the vehicle collided with a truck on West Side Avenue Thursday night. According to investigators, the tractor-trailer pulled out of a driveway on West Side Avenue, causing the collision.

Daniel Rodriguez, 18, of North Bergen was the driver of the Infiniti that collided with the truck. He remains at the hospital in critical condition.

The crash is still ‘under investigation,’ and the prosecutor’s office is asking the public for witnesses to come forward with any information they may have on the crash that sent both Daniel Rodriguez and William David to area hospitals.

In 2017, Hudson County recorded 26 deaths due to car accidents.

A New Jersey truck accident lawyer says drivers of tractor-trailers are often well-trained, but they have to be very alert when entering roadways. There are also many more factors that need to be investigated where the collision involves large trucks.

Truck crashes are often traced back to driver error, but there could be several factors that contributed to the crash. An extensive investigation can analyze a truck driver’s record and the number of hours he’s spent working; both outside the truck and while behind the wheel.

Although driving records can be important in any investigation, an experienced attorney can find other pieces of evidence that could help a victim’s family maximize their compensation when filing a claim. A thorough legal investigation will look at other factors, including:

  • Truck maintenance records
  • Overall road safety
  • Surveillance video
  • Traffic signals
  • Dashcam video from the truck itself or other drivers in the area
  • Road striping
  • And More

William David is the 15th traffic fatality in Hudson County this year, and almost all of these accidents were preventable. In many cases, victims and their families choose to file lawsuits to get compensation for their injury or loss of a loved one. This compensation can include several items, such as:

  • Expenses from hospitalization
  • Medical treatments
  • Loss of financial support from the victim
  • Pain and suffering

A successful claim can also help create meaningful changes in our communities that aim to improve the safety for others in North Bergen and Hudson County so that accidents like the one on West Side Avenue that killed William David and severely injured Daniel Rodriguez can be avoided in the future.

If you or a loved one have been hurt in any type of truck accident, you should contact an experienced personal injury attorney to help you through the legal process.

Broadway Stars Do #CellinoAndBarnesChallenge – And It’s Magical

/ News /

NEW YORK – Broadway stars have turned to social media to showcase their talented voices using a jingle almost every New Yorker knows – our famous Cellino & Barnes jingle. Using the hashtag, #CellinoAndBarnesChallenge, actors and actresses have been challenging others in showbiz to sing the jingle and put their own twist on it.

The challenge began with “Waitress” actress Molly Hager, and has since developed hundreds of different renditions.

A post shared by Molly Hager (@hagermolly) on

Many of those who were challenged to sing the jingle did so with their own spin on it, such as Hollywood and Broadway star, Madison Lagares (Blindspot, School of Rock, On Your Feet).

Other stars put together an entire performance. Fellow “Waitress” actress and Hollywood star, Katharine McPhee, teamed-up with Erich Bergen (Jersey Boys, Madam Secretary, Waitress) to sing their own version of the Cellino & Barnes jingle which has garnered over 100,000 views between the two of them.

Cellino & Barnes representatives said the viral challenge is nothing short of magical, and its origins were completely organic.

“We didn’t start the challenge, but we’re honored to be part of something amazing,” New York accident attorney, Steve Barnes said. “We’ve heard so many beautiful voices and talented individuals singing the jingle, and it’s been a lot of fun to watch.”

The Cellino & Barnes team has responded to the social media trend by challenging others to sing the jingle, using #CellinoAndBarnesChallenge. Because who knows; maybe you’ll be seen by showbiz brass and be called upon for their next Broadway show.

Motorcyclist Struck, Dragged By Truck in New York

/ Motorcycle Accidents, News /

ROCHESTER, N.Y. – A New York motorcyclist was rushed to the hospital this week after being dragged 150 feet by a tractor-trailer outside Syracuse, the Onondaga County Sheriff’s Office said.

According to CNYCentral, the crash happened Tuesday evening just after 6:30 on Vine Street near Oswego Street in the town of Liverpool, New York.

Deputies say the motorcyclist, Steven McGill, 27, was on his motorcycle when the tractor-trailer hit him from behind. Authorities said the truck driver, John Ries, didn’t see Steven McGill, and the truck continued to push the motorcycle 150 feet before another driver alerted the truck operator of the accident.

Unfortunately, Steven McGill was unable to get off his bike because it was jammed underneath the front of the truck, deputies said.

The rider was taken to Upstate University Hospital where he was treated for leg and abdominal injuries, CNYCentral reported.

A New York motorcycle accident lawyer says truck drivers have to be alert when driving in the cities, towns, and villages of Western and Central New York. There are also other factors that should be looked at when a motorcyclist is injured by a tractor-trailer or other large vehicle.

Every year, hundreds of New Yorkers are injured or killed in motorcycle-truck accidents that can be linked back to a negligent or inattentive driver. An extensive legal investigation could look at a trucker’s driving record and the number of hours he has spent behind the wheel.

Fatigue is often a common cause of a New York truck crash, and drivers are required to the log their time operating these large vehicles. Unfortunately, many drivers are pushing their bodies to the limit, and in some cases, they’re breaking the law. An experienced New York motorcycle accident lawyer can collect these logs as evidence that could help an injured victim get the best result possible from an injury claim.

Although driving records can be important in an accident investigation, a New York truck accident attorney could uncover additional pieces of evidence that could help maximize a victim’s compensation. This evidence could include:

  • Truck maintenance records
  • Overall road safety
  • Road Striping
  • Traffic signals
  • Surveillance video
  • Dashcam video from the truck itself or other drivers in the area

This year has already been a dangerous year for motorcycle riders in New York State. Many other bikers have been hit by speeding cars, inattentive drivers and tractor trailers in places like Syracuse, Buffalo, and Rochester. Many of those victims have suffered life-altering injuries as a result of a New York truck accident, and some could receive significant compensation for their injury or loss, which helps cover the following costs:

  • Expenses from hospitalization
  • Lost time at work
  • Reduced wages
  • Loss of protection or care
  • Pain and suffering

A successful case can also pave the way for meaningful changes in our communities that could improve the safety for other motorcyclists, bicycle riders and pedestrians in Western and Central New York towns and cities like Syracuse, Rochester, and Buffalo.

33 Injured in NJ Bus Accident

/ News /

NEW YORK – Dozens were injured on the New Jersey Turnpike in the overnight hours when a tractor-trailer and a tour bus collided near West Deptford, New Jersey.

Officials told ABC 6 News in Philadelphia that the crash happened at 12:30 a.m. Friday morning in the southbound lanes. Destined for Atlanta, there were 50 people on the Panda Tour Bus that departed from New York. Current reports estimate that over 30 of those passengers were injured, and taken to area hospitals.

It is unclear what caused the crash, but many riders told reporters about their experience, including Dwight Baylor of Brooklyn and Lucy Mongy of Harlem.

“The bus started flipping, then flipped over,” Dwight Baylor told reporters with ABC 6. “I fell on my back, and they were trying to help me up.”

Lucy Mongy said she heard several ‘booms’ before the bus rolled over.

“I felt like it was correcting direction,” Lucy Mongy said. “And then I heard another boom, and then we started tipping.”

An accident investigation should determine what caused the crash, but a New York bus accident attorney says there are many other factors that need to be evaluated, including:

Driver records for both the bus driver and the truck driver.

An analysis of the vehicles involved. Sometimes faulty brakes, poorly inspected tires or other defects can be factors in crashes like this.

Poor road conditions or unsafe infrastructure can also contribute to an accident.

Expert medical analysis are also important records that can help those who were injured in the crash obtain fair compensation.

An experienced New York bus accident lawyer can immediately start a legal investigation to cover these possible factors, and more. A complete analysis of the vehicles involved, driver records, road conditions, and expert statements can be extremely useful for passengers seeking compensation after a New Jersey bus crash.

In other New Jersey bus accidents, families have been able to recover compensation that can help pay for expenses like:

  • Hospital bills
  • Lost Wages
  • Pain & Suffering
  • Extended care
  • Future treatments
  • And more

Many victims of a New Jersey bus crash can also have unanswered questions. Although not every question has a clear-cut answer, an intensive legal investigation can help get answers to many of the unknowns:

  • Did the truck pass safety inspections?
  • Was there anything wrong with the bus?
  • Were the drivers well trained?
  • Were headlights functioning properly?
  • Did the truck or bus pass safety inspections?

Recent studies have found that fatigue can play a major role in many truck and bus accidents. New York bus accident attorneys say this possible factor should be considered due to the timing and location of Friday’s accident.

New York bus accident lawyers will not only help injured passengers and their families obtain compensation – they can also analyze the crash and uncover ways that future accidents can be minimized or prevented.
