Falls Among Older Adults
Some of the most common slip and fall accidents happen to those aged 65 and older. Researchers at the Centers for Disease Control and Prevention estimate more than 2.5 million people are treated in emergency rooms for slip and fall injuries each year.
Doctors also note that these injuries are largely preventable. That’s one reason why the Long Island slip and fall attorneys at Cellino & Barnes will fight for you in and out of court to get the best possible results for you and your family.
These accidents can most often be avoided by providing properly lit areas, railings, and ramps instead of stairs. The lack of these precautions can sometimes result in mild, moderate or severe injuries and too often, these safety features are not correctly installed or absent completely.
Fall on Uneven Pavement or Stairs
In most cases, property and business owners are responsible for the upkeep and maintenance of all areas used by the general public, including sidewalks, parking lots and stairways. Although maintenance can sometimes be costly, the lack of maintenance can result in even more costly injuries.
An individual who falls down a flight of stairs because a railing wasn’t properly maintained can suffer head trauma, broken bones and sometimes paralysis. These injuries can almost always be prevented with regular property maintenance.
The Long Island slip and fall lawyers at Cellino & Barnes have helped hundreds of clients recover more than $2 billion in verdicts and settlements following a fall down stairs or a trip on uneven pavement.
Slip on a Wet Floor
Another common accident occurs when an individual slips on a wet floor. This can sometimes be the result of a spill that has not been immediately or properly cleaned.
These accidents have been known to send thousands of people to emergency rooms every year. At Cellino & Barnes, our Long Island slip and fall lawyers know how crushing these injuries can be to New York families; our lawyers work with those families every day.

After A Fall – Collecting Evidence
After you experience a fall, whether it be at a department store, grocery store, or restaurant, we highly recommend following these steps:
- Take Photos. At the accident location, make sure to take plenty of pictures, including your clothing, any injuries, and what caused you to fall.
- Witnesses. If someone saw you slip and fall, make sure to ask for their name and phone number.
- Accident Report. If your fall occurs in a public location, such as a department store, gas station, or grocery store, make sure you file an accident report. You can do this by asking for the manager or property owner, who will then document your statement for what happened. Make sure to ask for a copy of the accident report before you leave. This will prove to be valuable for representing you for your injuries.
- Evidence. If possible, save the item that caused you to fall. For example, if you slipped on a piece of fruit or a vegetable, put the item in a bag and freeze it. You may also want to keep a hold of the shoes you were wearing at the time of the fall. These can be placed in a plastic bag and taped shut to preserve any matter stuck to your shoe.
If you are unable to take pictures or get any witness statements, an attorney at Cellino & Barnes law firm will obtain as much information as possible about the incident. Please keep in mind obtaining information hours, days, weeks or even months after an accident scene has been cleaned up or your injuries have healed is a much more difficult legal matter. Although medical records will document any injuries you may have received, pictures and witnesses will be valuable before a jury.
